Right now I have the windows open to let the cool air in and I am going to turn the fan on and see if that helps also, what else can I do to help the lil guy? He has fresh water and I will see how he does tonight.

Be very careful if you are leaving windows open. If there is a breeze and the window is open for an extended period of time there will be a high chance of your chin catching a respitory infection. You don't want that.
Fans won't help a chinchilla because they just circulate air. They don't actually cool the air. Chichillas don't sweat so a fan is no good to cool them.
Why do you think it's too hot? You should have a thermometer there to monitor the temperature.
Are you sure he isn't sick? If there is a problem with a chinchilla they will become lethargic...

How is is eating? Is his fecal output normal? Also what do you mean by "isn't being active?" If he is acting like he is sick do not hesitate to make a vet appointment. If he has not been eating and has no fecal output make it an emergency vet visit if you want to save him. Same goes if he is straining to breathe or has mucus from his eyes or nose.
